CE EMC vs Toy Safety Directive Certification: Key Differences for Electronic Toys

Electronic toys sold in the EU need EMC conformity and Toy Safety Directive compliance. What each covers, how the tests differ and what to ask a supplier for.

An electronic toy placed on the EU market has to satisfy two separate sets of rules before it can carry the CE mark. One governs its electromagnetic behaviour, the other governs its safety as a toy. Buyers often ask us for “CE” as if it were one certificate. It is not, and knowing the difference is what lets you check a supplier’s paperwork instead of taking it on trust.

CE EMC: the Electromagnetic Compatibility Directive

Legal basis: EMC Directive 2014/30/EU.

What it covers: that a product neither emits electromagnetic interference above the allowed limits nor fails when exposed to interference from other equipment. For a toy that means the sound module, the radio link in a Bluetooth or Wi-Fi product, and the switching circuits that drive lights and motors.

Applies to: any toy with active electronics, from an LED torch to an AI plush.

Typical test standards: EN 55032 and EN 55035 for emissions and immunity, with the EN 61000-4 series for electrostatic discharge, radiated immunity and surge.

How Chloe Toys handles it: EMC is designed in, not tested in. Our PCB layouts are reviewed for emissions before a board is released, and the assembled sample is pre-screened before the third-party test, so the formal report confirms a result rather than discovering one.

Toy Safety Directive: the safety of the toy itself

Legal basis: Toy Safety Directive 2009/48/EC, which the EU Toy Safety Regulation replaces over a multi-year transition. The harmonised standards below carry across.

What it covers: physical and mechanical hazards, flammability, chemical migration and, for electric toys, electrical safety.

Applies to: every product designed or intended for play by children under 14.

Typical test standards: EN 71-1 (mechanical and physical), EN 71-2 (flammability), EN 71-3 (migration of 19 listed elements) and EN IEC 62115 (electric toys). REACH chemical restrictions sit alongside, and articles containing substances of very high concern must be notified to the SCIP database.

How Chloe Toys handles it: the age grade, the intended market and the risk assessment are fixed at brief stage, because they decide the material list, the small-parts rules and the battery compartment design before any tooling is cut. Material certificates are collected per production lot, not once at sampling.

The differences that matter to a buyer

  • Legal basis: EMC Directive 2014/30/EU on one side, Toy Safety Directive 2009/48/EC on the other.
  • Scope: EMC covers electromagnetic behaviour only; the Toy Safety Directive covers physical, chemical and electrical safety.
  • Key tests: radiated and conducted emissions plus ESD and radiated immunity for EMC; small parts, sharp edges, flammability, heavy-metal migration, battery and heating checks for toy safety.
  • Who signs: the manufacturer’s EU Declaration of Conformity in both cases. An EC-type examination by a Notified Body is needed for toy safety only where no harmonised standard covers the hazard.
  • What reopens a report: for EMC, a PCB or firmware change; for toy safety, a change of fabric, paint, filling or battery.

Electronic toys need both. A talking plush, for example, has to pass EN 55032 and the EN 61000-4 series for its electronics, and EN 71-1, -2 and -3 plus EN IEC 62115 for the toy.

Why it is worth getting right

  • Products found non-compliant are listed on the EU Safety Gate rapid-alert system (formerly RAPEX) and can be withdrawn from every member state at once.
  • Customs can ask for the Declaration of Conformity and the supporting test reports at import. A missing EMC report holds an electronic toy at the border as surely as a missing EN 71 report does.
  • A design that passed once is not certified forever. Any change to the PCB, firmware, battery, fabric or paint should be checked against the reports on file.

Procurement checklist

Ask any supplier of electronic toys for:

  1. The EU Declaration of Conformity naming both directives and the standards applied.
  2. EMC test reports (EN 55032, EN 55035 or the applicable product standard, and the EN 61000-4 series) for the exact PCB revision and firmware.
  3. EN 71-1, -2 and -3 and EN IEC 62115 reports for the exact material set and colourway.
  4. Material certificates for the current production lot, not the sample lot.
  5. Confirmation of REACH screening and, where relevant, the SCIP notification.
